1. Acceptance of Terms
By accessing or using Calypso ("the Service"), operated at calypso.build, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Calypso.
2. Description of Service
Calypso is an AI-powered web design and development platform that enables users to plan projects, generate designs, produce production-ready code, and deploy websites. The Service includes AI-powered design generation, code generation, project management tools, and hosting capabilities. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
3. Eligibility
You must be at least 18 years old to use the Service. By creating an account, you represent and warrant that you meet this age requirement and that all information you provide is accurate and complete.
4. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating an account and keep it up to date. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss resulting from unauthorized access to your account.
5. Subscriptions, Tokens, and Billing
Calypso offers free and paid subscription plans. Paid plans are billed in advance on a monthly basis through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis.
Token packs are prepaid, non-refundable, and non-transferable credits used to access AI-powered features. Token usage is tracked on both a monthly and daily basis according to your plan limits.
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until then. We do not provide pro-rated refunds for partial billing periods.
6. License to Use the Service
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service in accordance with these Terms and your subscription plan. This license is for your personal or internal business use only.
7. Intellectual Property
Your content: You retain full ownership of all projects, designs, code, and other content you create using the Service ("Customer Data"). You may use, modify, distribute, and commercialize your Customer Data without restriction.
AI-generated output: Code and designs generated by the Service's AI features are owned by you. AI output may contain errors or inaccuracies, and you are solely responsible for reviewing, testing, and validating any generated content before use in production.
Our platform: Calypso retains all rights, title, and interest in the Service itself, including the platform, its design, user interface, underlying technology, and all associated intellectual property.
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Generate content that is harmful, abusive, harassing, defamatory, or that promotes violence or discrimination.
- Attempt to gain unauthorized access to the Service, other user accounts, or any related systems or networks.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Use automated tools (bots, scrapers) to access the Service beyond normal usage patterns.
- Use AI-generated output to train competing AI models.
- Resell, sublicense, or redistribute access to the Service without our written consent.
- Upload malicious code, viruses, or any content designed to interfere with the Service's operation.
Violation of these restrictions may result in immediate suspension or termination of your account.
9. AI Disclaimer
The Service uses artificial intelligence to generate designs, code, and other content. AI-generated output is provided "as is" and may contain errors, inaccuracies, security vulnerabilities, or other issues. You acknowledge that:
- AI output should not be used for safety-critical, medical, financial, or legal applications without independent review by qualified professionals.
- You are solely responsible for testing and validating all generated code before deploying it to production.
- We make no guarantees regarding the accuracy, completeness, suitability, or security of AI-generated content.
10. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. The Service depends on third-party infrastructure providers (including Vercel, Neon, and Stripe) and AI providers (including Anthropic). We are not responsible for outages or degraded performance caused by third-party providers, internet connectivity issues, or events outside our reasonable control.
11. Termination
You may terminate your account at any time by deleting it through your account settings or by contacting us.
We may suspend or terminate your account immediately and without notice if you violate these Terms, engage in fraudulent activity, or if continued access poses a security risk. We may also terminate your account with 30 days' notice for any other reason.
Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALYPSO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
14. Indemnification
You agree to indemnify and hold harmless Calypso and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, your violation of any third-party rights, or any content you create or deploy using the Service.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware. You waive any objection to jurisdiction and venue in such courts.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through a notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the changes.
17. Miscellaneous
- These Terms constitute the entire agreement between you and Calypso regarding the Service.
- If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
- Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
- You may not assign or transfer your rights under these Terms without our written consent.
